TERMS

AND CONDITIONS

By ordering from Dream Cakes & Heavenly Bakes, you agree to the following terms & conditions & accept that these conditions maybe modified or amended & posted on the website from time-to-time.

PRICES:

The price shall be as stated on your order form and you agree to pay the company the price quoted after checking the details, agreeing and sending back an email of confirmation for your order. In turn I will then accept your order by emailing with the cost of the deposit.

BOOKINGS & DEPOSITS:

All orders are secured with a non-refundable and non-transferable deposit of 35% of the total cost of the cake/cakes, rounded to the nearest £. Deposits become due once the order has been placed, the details checked and agreed by you & I've received your order confirmation email. Once deposits are received your booking date will be fully secured & your invoice will be sent.

NOTICE:

Cake orders need to be decided on and placed 2 weeks in advance of the date you wish to have them ready for. Please feel free to ask to place orders with shorter notice, as I may be able to oblige depending on the date, amounts and type of cake/cakes required.

PAYMENTS:

Bank details will be provided with the deposit email I send once order confirmation has been received. 35% of the total cost of the cakes/cake, rounded to the nearest £, will be required but if you wish, full payment can be made at this point too.

FINAL PAYMENTS:

Final payments must be made by bank transfer 6-7 days prior to delivery, as stated on the order form, in order for the transfer to clear.

NON-PAYMENT:

In the event that payment is subsequently declined, the order will not be completed or released until alternative funding arrangements have been agreed and payment is made in full. In these circumstances, subsequent completion of the order on the required date will be subject to availability and may not be guaranteed. The company accepts no responsibility for any loss howsoever caused or for non-delivery under these circumstances.

CANCELLATIONS AND REFUNDS:

Full payment is required if cancellation is within 1 week of delivery/collection date, prior to this a refund of any monies you have paid, less the deposit, will be made. 

All cancellations must be made via email. Please also see "Cake Problems" below.

ALTERATIONS:

Your cakes/cake is very important to me. Please take the time to check your copy of the order form carefully and let me know within three days if changes are needed. It is your responsibility to advise the company of any alterations to the original order. The company reserves the right to increase a quoted fee in the event that the customer requests a variation to the work agreed that may change the cost and therefore price of the cake/cakes. Whilst every effort will be made to assist customers, please note that late changes cannot always be guaranteed.

CAKE COMPONENT PARTS:

From time to time certain products for cakes/decorations may become obsolete or no longer be available from suppliers. This is totally out of my control, however we will endeavour to re-design a cake to reflect as closely as possible the original design using replacement products. In all cases we will try to contact you to advise you of any such changes, however the company reserves the right to replace these with components of equal or better quality without consultation.

Please be aware that some cakes/decorations will have dowels/cocktail sticks in, etc, which you will be notified about in your Important Information letter, delivered with your order. It is the customers responsibility to remove these before cutting the cake as requested in the Important information letter. I take no responsibility for any injury or harm resulting from ingesting said items.

DELIVERY:

Your order can be delivered between 9:00am and 5:00pm Monday to Friday and between 10:00am and 12:00pm on Saturday and Sunday, unless by prior agreement between you and the company. We will deliver at the time and address agreed with the customer on the order. It is the customers responsibility to ensure that you have given us correct delivery information and that someone is available to receive your cake. A signature will be required for the receipt of the order upon delivery. If we can't deliver because there is no one to receive the product or the address provided is wrong, the cake/cakes will return to the company who will contact you to arrange an alternative delivery time, for which an additional charge will be payable by the customer. The company accepts no responsibility for any loss or consequential loss incurred by the customer as a result. The company takes no responsibility once the cake has been handed over.

STAND HIRE:

Unfortunately I do not supply cake stands for hire, due to losses and breakages. However check with your venue, otherwise you should be able to buy/hire these easily.

ALLERGIES:

All my products are baked in a kitchen that at some time handle:

celery, cereals containing gluten, crustaceans, eggs, fish, lupin, milk, mustard, nuts, peanuts, sesame seeds, soya and sulphur dioxide. Please DO NOT eat these products if you are allergic to any of these things, as they may contain trace amounts even if they are not part of the ingredients.

Please be aware that whilst your chosen cake/cakes may not be made with nuts or a nut product or other allergens, it will be prepared where these products are used in other cakes/fillings/decorations. So whilst I take steps to minimise any risk of cross-contamination I CANNOT guarantee this. No absolute nut free guarantees can be given as some ingredients are not guaranteed nut free by the manufacturers. Allergy information is provided on the website as well as with the order.

It is the customers responsibility to inform me of any dietary requirements, I take no responsibility for any injury or illness resulting from allergies and sensitivities to any ingredients. It is also the customers responsibility to pass the allergens information provided onto any third parties concerned.

Please also be aware that certain food dyes/colourings may have an adverse effect on the activity and attention in children. You may also find brightly coloured bakes may dye peoples teeth/tongues and I will only use the amount that is stated as safe to do so. 

CAKE PROBLEMS:

Although unlikely, as all cakes are taste tested & signed for to say customers are happy, if you are unhappy with your cake/s or have a complaint, please call me and explain the situation no later than the day after the event. The cake/s or at least half of these must then be returned within 2 days of the event to ensure I am able to fully and fairly assess the problem at hand and it provides proof that you were indeed unhappy with the cake and could not use it for your event. The maximum refund that will be offered is the value of the cake. No further compensation is available.

In the unlikely event that I have to cancel your order for any reason, I will give you as much notice as possible and discuss the matter with you and attempt to agree a suitable alternative. If this is not acceptable to you, then I will refund the full cake price. 

COVID-19 (CORONAVIRUS):

As stated by the government, It is very unlikely that you can catch coronavirus (COVID-19) from food. Cooking thoroughly will kill the virus. COVID-19 is a respiratory illness. It is not known to be transmitted by exposure to food or food packaging, therefore it is not considered a food safety issue by the Food Standards Agency.

However as a registered and insured business I continue to maintain vigorous hygiene practices, following government advice to ensure health and safety, as stated in my COVID-19 (Coronavirius) update. 

Therefore as I continue to follow the FSA advice and requirements for maintaining diligent and strict hygiene standards, the Governments advice on “Coronavirus and Food”, using social distancing measures to ensure health and safety and providing a COVID-19 (Coronavirus) awareness/measures update, I take no responsibility for any injury or harm resulting from the unlikely exposure to COVID-19 (Coronavirus). You voluntarily assume all risks related to exposure to Covid-19 & agree not to hold Dream Cakes & Heavenly Bakes liable for any illness or injury.

On receiving your order form by email and replying that you are happy to go ahead, you agree to hold Dream Cakes and Heavenly Bakes harmless for any allergic reactions/all liabilities related to the above and to indemnify Dream Cakes and Heavenly Bakes in the event of any claims arising from allergic reactions/all liabilities related to the above.
